Please read these Standard Terms of Use (“Terms”) carefully. By using the Service (defined below) or signing up for an account, you’re agreeing to these Terms, which will result in a legal agreement between you and Unitag QR (collectively, “Unitag,” “we,” “the publisher” or “us”).

Article 1 - Acceptance of the conditions of use of the site

By accessing this website and/or by using its services, the User agrees to the following Terms of Service and more generally all the applicable legal and regulatory provisions.

The Site editor reserves the right to update these general conditions of use at any time.

The Site editor therefore invites any user to visit this page each time the site is consulted in order to become acquainted with it.

Access to the free QR Codes editing service on the “Public Generator” is reserved for legal entities and adults.

Article 2 - Description of the service via the free public generator

2.1 QR Code Generator

This offer allows the User to create personalized QR Code and download it to his computer in order to be able to print them later.

The "Free" QR Codes may contain the following information in particular:

  • The URL of a website
  • A phone number, an email address or wifi credentials
  • An event or a location (via coordinates)
  • A simple text

Free QR Codes have their visuals fully editable.

The User can download the file corresponding to the QR Code.

A QR Code generated via the Public Generator cannot be edited and can be scanned up to a 100 scans.

It is important that the User carries out scanning tests himself under conditions similar to the final environment of the QR Code with several QR Code scanning applications. The User acknowledges that Unitag cannot be held responsible for scanning problems.

2.2 Limitations of the Public Generator

A QR code created on the Public Generator is limited to 100 scans. This limitation shall not be applied to HD QR codes following the purchase of the QR code via the Public Generator. In the case of the purchase of an HD QR code no scan limit shall be applied to the said QR code

Unitag reserves the right to modify the definition of the free offer at any time and without notice. Unitag reserves the right to archive any product overruns.

Unitag agrees to archive QR codes exceeding the authorized limit for a maximum period of 6 months in order to be able to restore them. Following this period, Unitag reserves the right to permanently delete these qr codes.

Any support on a QR code SD outside of changing a destination URL (following a mistake) will be invoiced at 29.90€. This price includes the support and engineering time.

Article 3 - Subscriptions

Unitag offers various subscriptions, details of which are available on the Site.

3.1 Principles

The subscription contract comes into action on the date of validation of the order by Unitag, for an initial period which begins when the User places the order. At the end of the initial period, the subscription is renewed automatically for successive periods of the same duration as the initial period chosen, unless terminated by the User under the conditions below. A trial period is sometimes given by Unitag on certain offers. The subscription contract begins at the end of this period.

Disabling automatic renewal.

The User can, at any time, deactivate the automatic renewal of his subscription. For this deactivation to be effective and taken into account for the current subscription period, the User must use the action provided for this purpose from their account page (parameters), in the Billing and Subscriptions tab.

Consequences.

When the User requests the deactivation of automatic renewal within the allotted time, the subscription continues until the end of the current period and is not renewed. Therefore, at the end of his subscription, the User loses the benefit of the paid Services and any remaining credits, then is switched to an Archived account. Unless the User requests otherwise in writing, their data may be kept (archived) by Unitag for a maximum period of six months. If the User subsequently decides to resume a subscription, the stored (archived) data can be restored.

No full or partial refund, including in the event of non-use of the Services (including options) will be made or accepted.

Modification of the subscription.

The User can modify his subscription within the limits set in his account area.

The same account cannot combine several subscriptions. The purchase of a new subscription plan automatically terminates and replaces the existing subscription plan, with no possible refund of the amounts paid.

Credit value and use.

Each user account has a limit of credits allocated to certain Unitag services. Each subscription has a credit limit on the creation of qr code dynamic / dynamic pro. Thus, the number of credits decreases by 1 when a dynamic or dynamic pro qr code is created and goes up by 1 if a dynamic or dynamic pro qr code is deleted. The principle remains the same for VCards and collaborators credits or any other services depending on credits for its behaviour.

3.2 Options

The ordering, renewal and use of options by the User require that the latter have a subscription. These options concern: VCards, collaborators, Packaging or other services and options available through the Platform.

Any option included in the subscription plans must be activated by the User. No partial refund of the subscription will be made in the event that the User does not use the option.

Article 4 - Account and Activities

4.1 Paid accounts and subscriptions

Price - payment.

The applicable price is that in force on the day of invoicing. The price is indicated including VAT. Our Services are payable when ordering, except for otherwise stated in writing when ordering

The User acknowledges and accepts that the limitations of paid accounts are those defined by the commercial offer accessible via https://console.unitag.io/plans. Unitag reserves the right to modify these offers at any time and without notice. Unitag reserves the right to change the price of these offers but undertakes not to change the price or request the difference between the previous and new price of a current subscription. Any rate change will be effective upon automatic or manual renewal of a subscription.

4.2 Closure of account

The User or Unitag may terminate a contract at any time and for any reason by terminating the Unitag account or by notifying the other party.Unitag reserves the right to suspend User activity at any time with or without cause.

If the User has a subscription account upon termination without justification, Unitag will reimburse a pro rata portion of any prepaid amount for the service (including a monthly fee).

We will not issue a refund if:

You have subscribed to a monthly subscription for more than 12 hours and you decide to suspend your subscription.

You have subscribed to a year-round subscription for more than 5 working days and you decide to suspend your subscription.

Your account is suspended or terminated for just cause, such as a breach or violation of the Agreement.

If your account is inactive for 24 months or more, Unitag reserves the right to terminate your account and without refund of any prepaid service. Once the user account is terminated, the User acknowledges and accepts that Unitag can permanently delete your account and all associated data.

4.3 Account and password

The User is responsible for the confidentiality of his account name and password.

The User is also responsible for any account to which he has access and for any activity occurring in this account (other than the activity for which Unitag is directly responsible and which is not carried out in accordance with the instructions), which the User has or not allowed this activity.

The User must inform Unitag immediately of any unauthorized access or use of his accounts. Unitag is not responsible for losses due to stolen or hacked passwords.

Unitag does not have access to the User's current password, and for security reasons, Unitag can only provide the User with instructions on how to reset their password.

Unitag does not have the right to update your contact details in the User's account for billing purposes. In addition, the User declares and guarantees that all information provided when creating an account, and when accessing and using the Service, is and will remain complete and accurate. Unitag may contact you, or any other headquarters, authorized user or login added to your account, depending on the information provided in your account.

Article 5 - Access to the site and services

The publisher strives to offer permanent access to the site, 24 hours a day, 7 days a week. However, access to the site may be suspended at any time and without notice, in particular due to breakdowns, failures or paralysis of the network, system and / or means of communication, as well as due to maintenance and corrective interventions made necessary by the updating and proper functioning of the site.

The User undertakes not to hinder access to the site and / or the proper functioning of the site in any way whatsoever, liable to damage, intercept or interfere with all or part of the site.

The publisher cannot be held responsible for any direct or indirect damage due to an interruption, to any dysfunction whatsoever, to a suspension or to the shutdown of the site and / or services, and this for any reason whatsoever. either or any direct or indirect damage which would result in any way from access to the site and / or services.

The Unitag User acknowledges having the skills and means necessary to access and use this site. The communication protocols used are those in use on the Internet. The site and the platform are compatible with most recent browsers.

The publisher cannot be held responsible for elements beyond its control and for any damage that may be suffered by the technical environment of the user and in particular, his computers, software, network equipment and any other equipment used to access or use the site and / or the services.

It is recalled that the fact of accessing or remaining fraudulently in a computer system, of hampering or distorting the operation of such a system, of fraudulently introducing or modifying data in a computer system constitute punishable offenses. criminal sanctions.

The costs of access and use of the telecommunications network are the responsibility of the User, in accordance with the terms set by their access providers and telecommunications operators.

Article 6 - Site content

Unitag takes reasonable precautions to ensure the physical protection of its platform and associated services.

However, Unitag cannot be held responsible for elements beyond its control and for any damage that may be suffered by the technical environment of the user and in particular, his computers, software, network equipment and any other material used to access or use the platform and the QR Code.

Article 7 - Intellectual property

The entire site and the QR Code generation platform (structure, presentation and content) constitute works protected by French and international legislation in force on copyright and, in general, on property. intellectual.

The publisher is the owner, assignee or holder of the rights to all the elements that make up the site and the Platform, and in particular texts, data, drawings, graphics, photos, animations, sounds, computer codes, fittings, assemblies of all or part an element of this site including downloadable documents.

All rights, including in particular exploitation rights, reproduction and extraction rights on any medium, of all or part of the data, files and all elements appearing in the web pages of this site, as well as the rights of representation and reproduction on any medium, of all or part of the site itself, the rights of modification, adaptation or translation, are reserved exclusively for the publisher, - and any beneficiaries - and this, subject to the pre-existing rights of third parties who have authorized the digital reproduction and / or integration into this site, by the publisher, of their works of any kind.

Unitag allows the User to personalize their QR Codes via the Platform and in particular to integrate into their QR Codes elements protected by intellectual property law or personality rights (photos, images, logos, texts and much more).

The User declares that he has sufficient rights to authorize Unitag to represent and then reproduce the QR Code thus generated on the Platform as part of the provision of the Service. In addition, the User acknowledges and accepts that the dissemination of QR Codes by any means whatsoever is carried out under their sole responsibility and under their control. As such, the User undertakes to release and guarantee Unitag against any recourse by third parties under the conditions provided for in article 8 hereof.

Unitag grants the User the right to reproduce and represent each QR Code generated through the Platform on any medium of his choice, without limit of number or format, worldwide and this, during the term of protection. applicable to these works.

The possibility of personalizing the QR Code presents a random component. Consequently, Unitag cannot guarantee the absence of similarities between two QR Codes generated on behalf of different customers or Users. It is therefore up to the User to personalize his QR Codes so as to distinguish them from those of other Users or third parties.

Consequently, Unitag cannot be held liable for an action for infringement or unfair competition directed against the User relating to the resemblance of the QR Code to those of a third party.

Article 8 - Hypertext links

The site may contain hypertext links allowing access to sites which are not produced by the publisher of this site. Consequently, the latter cannot be held responsible for the content of the sites to which the Internet user would thus have access.

The creation of hypertext links to the home page of the site is authorized. Links made to specific pages of the site (deep links or "deep linking") are subject to prior authorization from the Publisher.

The URL of the targeted page must be clearly indicated. The user site must not make the site appear to be its own, distort the content of the target site, refrain from clearly indicating that the user is directed to the site. Article 10 - Responsibility

The User acknowledges and accepts that the Services offered through the Platform fall within a particularly complex field in terms of IT technology and that they cannot materially do, in particular in the context of the shared use of their functionalities, the object of tests or experiments covering all the possibilities of use.

As this is a free service, provided as is, Unitag does not grant the User any guarantee of proper functioning of the free services offered on the site and can therefore not be held liable for any reason whatsoever and specifically:

the difficulties or the time of access to the Platform due to the total or partial non-compliance with an obligation, a default and / or saturation at certain periods of the operators of telecommunications networks and / or suppliers of Internet access,

the content of the information transmitted and processed,

Unitag recalls that it is important for the Customer to carry out reading tests himself under conditions similar to the final environment of the QR Code.

virus contamination of Users' data and / or software, the protection of which is their responsibility,

damage to equipment connected to the Platform or its misuse, which is the sole responsibility of the User,

possible misappropriation of identifiers, and more generally of any information of a sensitive nature for the User,

the adequacy of the services offered to the specific needs of the User.

The User guarantees Unitag against any damage of any kind, any claim or legal action from third parties relating to the use of the Services and their results. As such, the User undertakes to indemnify Unitag against convictions of any kind, as well as indemnities, damages and attorney's fees and court costs.

Article 11 - Disputes

The publisher may rely as proof of all acts, programs, data, files, records, operations and other elements (such as monitoring reports or other statements) of a nature or in computer or electronic format or medium, established, received or kept directly or indirectly by the publisher, for example in any database.

Article 12 - Public QR Generator Refund

You won’t be entitled to a refund or credit from us under any circumstance. However, we may, at our sole discretion, offer a refund, discount or credit.

Article 13 - Applicable law - Attribution of jurisdiction

These general conditions of use are subject to French law, with the exception of any other legislation, regardless of the place of use.

Any dispute, in particular on the execution or interpretation of these general conditions, which cannot be resolved amicably will fall under the exclusive jurisdiction of the courts within the jurisdiction of the Toulouse Court of Appeal, regardless of the place of performance. benefits or services, the domicile of the defendant or the method of payment accepted, even in the case of a guarantee call, of a plurality of defendants or of summary proceedings or on request.

Article 14 - General

Advertising.

Unitag is authorised to mention the User's corporate name and the corresponding logos for commercial reference, as well as the services performed on behalf of the User for the purposes of illustrations or presentation of Unitag's achievements on any communication medium. These mentions are granted free of charge and may not be the subject of any compensation or remuneration in any way whatsoever.
